These Terms and Conditions (“Terms”) govern your use of the etspe.com website and related services (the “Service”) provided by Eagle Innovations (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms.
1. Eligibility
You must be at least 18 years old to use the Service. By creating an account you represent that you are 18 or older and capable of entering into a binding contract.
2. Account Registration
You agree to provide accurate and current information when creating your account, and to keep that information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
3. Subscription Plans
We offer the following subscription tiers:
- Trial — 30 days of full Premium access at no cost. Automatically converts to the Limited plan when the trial ends unless you upgrade.
- Limited — Free; play limited to 4 rounds within any 6-month period.
- Pay Per Play (PPP) — $2 per round played, billed monthly in arrears, capped at $20 per month.
- Premium Monthly — $15 per month, recurring.
- Premium Annual (Monthly) — $10 per month for 12 months, recurring.
- Premium Annual — $100 per year, recurring.
- Lifetime — $500 one-time payment.
Pricing is in U.S. dollars and may change with reasonable notice to current subscribers.
4. Billing and Payment
Subscription fees are billed in advance through Stripe, Inc., except Pay Per Play which is billed monthly in arrears based on rounds played during the prior month. You authorize Eagle Innovations and Stripe to charge your payment method for all amounts due.
If a payment fails, we will attempt to retry the charge and may downgrade your account to the Limited tier after 30 days of non-payment.
5. Cancellation and Refunds
You may cancel your subscription at any time through your account or by contacting css@eiimail.com. Cancellation takes effect at the end of the current billing period; you retain access until that date.
We do not offer refunds for partial billing periods or for unused portions of a Lifetime subscription, except as required by law.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to other accounts or our systems
- Resell, sublicense, or commercially exploit the Service without our written permission
- Submit false or misleading information, including scores, tournament data, or handicap information
- Interfere with or disrupt the Service or related infrastructure
7. Tournament and Score Data
Scores you post and tournaments you participate in are shared with applicable golf associations, leagues, and tournament administrators as part of the Eagle Tournament System ecosystem. This information may be visible to other members of leagues, clubs, or events in which you participate.
8. Intellectual Property
The Service, including its software, design, content, and trademarks, is owned by Eagle Innovations and protected by U.S. and international copyright and trademark law. You receive a limited, non-exclusive, non-transferable, revocable right to use the Service for personal, non-commercial use during your subscription.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EAGLE INNOVATIONS AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. Our total cumulative liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Eagle Innovations, its affiliates, and their respective officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Service or violation of these Terms.
12. Modifications
We may modify these Terms from time to time. Material changes will be announced via email or on-site notice. Continued use of the Service after changes take effect constitutes acceptance.
13. Termination
We may suspend or terminate your account for violation of these Terms or for non-payment. Upon termination, your right to use the Service ends immediately. Sections of these Terms that by their nature should survive termination will do so, including without limitation Sections 8 through 11 and 14.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising under these Terms shall be brought exclusively in the state or federal courts located in Dallas County, Texas, and you consent to the personal jurisdiction of those courts.
